  • Private Student Loans | Beware Of Private Student Loans

Megan Connors of Harford County, Md., says she got a great education at Auburn University but a brutal lesson on private student loans.

Federal aid wasn't enough to cover four years at the Alabama school, so Connors made up the difference with private loans. Now, four years after graduation and working at a job far afield from her major, the prekindergarten teacher struggles to repay about $101,000 in private loans.

"If I knew I would be in this much debt, I probably wouldn't have pursued a four-year degree," said the 30-year-old, whose retired parents help with the loan payments.

Granted, Connors' case is unusual. But it's a dramatic example of how some young adults have relied on private education loans to fulfill a college dream, not realizing the long-term financial consequences to themselves and the family members who co-sign. It's an issue that has long concerned student advocates -- and now Congress.

The Dodd-Frank law requires the Education Department and the new Consumer Financial Protection Bureau to report on private education loans by July. As part of that, the consumer bureau recently announced it was seeking answers from students, schools and lenders to a series of questions.

  • First American Bank | First American Bank Begins Repaying Federal Bailout

(Crain's) - The parent of First American Bank has won approval from regulators to repay a portion of its federal bailout funds, making it the first privately held lender in the Chicago area to redeem preferred shares sold to the Treasury Department under the Troubled Asset Relief Program.

Elk Grove Village-based First American Bank Corp. on Wednesday will redeem $15 million of the $50 million in TARP shares held by the Treasury, CEO Thomas Wells said Friday.

The repayment was made possible after First American raised $26 million in fresh equity from existing shareholders over the summer, Mr. Wells said.

With $2.8 billion in assets, First American is the ninth-largest bank holding company in the Chicago area and the second-largest privately held one, behind Metropolitan Bank Group Inc. First American has 48 branches spread mainly throughout the suburbs, with eight in the city.

While a few of the biggest banks here like Northern Trust Corp., Lake Forest-based Wintrust Financial Corp. and Itasca-based First Midwest Bancorp Inc. have repaid their bailout funds, the Treasury still holds nearly $1 billion collectively in TARP shares of 17 area banks. The banks' painfully slow recovery from the recession has made it difficult for many of them to exit the program, created during the height of the financial crisis in 2008.

  • Loan | Clarification Regarding Loan And Write-Off To Related Party, OntarioCo

TORONTO, ONTARIO--(Marketwire - Dec. 29, 2011) - Valencia Ventures Inc. (TSX VENTURE:VVI) ("Valencia" or the "Company") is issuing this release to clarify the terms and write-off of its loan in the principal amount of $700,000 ("Loan") to a private Ontario company ("OntarioCo") at the request of the TSX Venture Exchange (the "TSXV").

Further to its news releases dated June 23, 2010, March 4, 2011, and June 20, 2011, the Company wishes to clarify that OntarioCo is a related party to the Company given that the spouse of Mr. Stan Bharti, Chairman and Director of the Company, is an Insider given her shareholdings of OntarioCo. Moreover, Mr. Bharti's adult son has a further material interest in OntarioCo as he is OntarioCo's sole director and officer, and a shareholder. The adult son was also the personal guarantor of the Loan.

The Company's press release of June 20, 2011 announced OntarioCo had repaid $127,000 on the principal of the Loan, resulting in an outstanding principal balance of $573,000. To clarify the $127,000 payment was paid to the Company from a third party as a result of the termination of the assumption agreements press released on March 4, 2011. No interest on the loan has been paid to date.

On June 2, 2011 the Company entered into an agreement with OntarioCo to write-off the outstanding balance on the Loan in return for 500,000 common shares of South American Rare Earth Corp. ("SAREC"), a private company. The 500,000 common shares of SAREC were valued at $100,000, based upon the valuation conducted by the third-party agents to the private placement completed by SAREC shortly prior to this agreement. As a result, the Company has recorded the remaining principal balance and interest of $526,890 as an impairment loss.

However, the Company has had discussions with the guarantor regarding payment of the remaining balance of the loan as well as unpaid interest.

  • Credit Solutions | Enforcement Agencies Continue To Fight Loan Modification, Mortgage Relief, And Foreclosure Rescue Scams

SACRAMENTO, Calif.--(BUSINESS WIRE)-- The California State Department of Real Estate (DRE) and other law enforcement agencies have alerted and continue to warn consumers to be wary of promises for loan modification, mortgage relief, and foreclosure rescue as scammers continue to prey on vulnerable, financially stressed homeowners. The DRE, whose mission is to protect the public interests in real estate matters, continues to file scores of actions against individuals and entities illegally offering loan modification and mortgage relief services. The most typical scam involves the assurance of a loan modification in exchange for an upfront fee (which is illegal under California law), but once the fee is paid, little or nothing is done to obtain a loan modification.

Since 2009, the DRE has filed over 1,100 administrative actions against loan modification scammers. The typical action involves the issuance of a Desist and Refrain Order to an unscrupulous operator ordering the stoppage of illegal activities, including the illegal collection of advance fees. However, in many instances an administrative order is insufficient to stop the illegal activity or the violations are so egregious that harsher action is necessary.

"It is imperative that law enforcement and administrative agencies work together to ensure consumers get the protection they deserve in these tough economic times" stated Barbara Bigby, DRE's acting Real Estate Commissioner.

In this regard, the DRE commends the recent announcement by the California Attorney General (AG) of the arrests of Christopher Fox and Curtis Melone who operated Green Credit Solutions Inc. Green Credit Solutions Inc. is accused of collecting millions of dollars in illegal advance fees for loan modification services that were not performed. The DRE had previously filed actions against Fox and Green Credit Solutions Inc. that resulted in the surrender of the real estate licenses of Green Credit and Fox. At the conclusion of DRE's case, the DRE investigators provided support to the AG in connection with their criminal case to ensure these scammers are subjected to more than just an administrative order.

In addition, recent actions taken by the Federal Trade Commission imposing million dollar judgments against Aminullah Sarpas, Damon Carriger and Macie Bain, all of whom had previously been issued Desist and Refrain Orders by the DRE for the illegal collection of advance fees, will help curb future abuses.

  • Credit Card Companies | First Person: When Credit Card Companies Attack

*Note: This was written by a Yahoo! contributor. Do you have a personal finance story that you'd like to share? Sign up with the Yahoo! Contributor Network to start publishing your own finance articles.

The recent tales of outrageous credit and debit card fees have left us feeling helpless. While it's often impossible to reason with a nameless, faceless corporation, I know firsthand that if you get the right set of facts to the right person, you'll get what you want.

About four years ago, I was in the midst of a divorce that drained my liquid savings. I had been forced to take a cash advance on a zero percent interest credit card. I had made complex calculations as to how much it would cost me in total and how quickly I could pay it back to avoid being stuck with a high interest rate once that introductory period had ended.

What I hadn't taken into consideration was the fact that credit card companies can -- and do -- change the minimum payment on a whim. I got notice that my minimum could more than double immediately. I would have had pay at least $600 a month. It was completely unmanageable financially, and I was distraught.

The total funds I had amassed in my various retirement accounts would cover the amount owed, but it would leave me nothing in case of an emergency. Additionally, closing the retirement funds would cost me a penalty, as well as future earnings. I had no choice, however. I sat on my bed with all of my financial accounts spread out around me. I got angry, then resolved. I called the credit card company.
